Summary

On 3 August 2020, Mahanakorn for Democracy Group - MDG (student activist group from Mahanakorn University of Technology) and Kased Movement (student activist group from Kasetsart University) jointly organized protest Spelling Patronus Charm to protect Democracy. in front of Macdonald restaurant on Ratchadamnoen Road.

Highlight of this protest was speech by Anon, a Human Rights Lawyer who publicly spoke about problem surrounding monarchy institution openly. A novel Harry Potter was used as theme of this protest to reflect that in Thailand the criticism on monarchy could not be done openly similar like in the novel where the speak of name Voldemort was prohibited.

The protest concluded with no violence incidents while the police arrest no one at the scene. On 19 August 2020, while Anon was on his lawyer duty at the Criminal Court group of men that were expected to be plaint cloth officials present at the court. Later in the evening after Anon left the court the police from Chanasongkram Police Station present arrest warrant and arrested Anon then brought him to the station.

Anon was held at the police station for a night, he was brought to the Criminal Court in the next day (20 August 2020). The Criminal Court approved the police's petition to remand Anon in custody. Anon then filed bail petition to the court and the court accepted it, Anon was then released.

Anon was the first but not the last to be prosecute for taking part in this protest. The police later summoned another 6 activists to acknowledge accusation due to the same incident. These 6 activists were informed of allegation under Public Assembly Act and Amplifier Act.

Since the police did not filed sedition allegation against these 6 activists, if the prosecutor filed the case to the court the 6 activists will be trial in municipal court while Anon who faced sedition charge will be tiral in the Criminal Court.

After Gen. Prayuth Chan ocha announced that all sections and all laws will be use against protesters who commit crime the police had informed Lese Majeste allegation to Anon as an additional allegation. The police went to informed Lese majeste allegation to Anon on 24 February 2021 while he was remanded in custory in another case
