Summary

Patnaree, mother of Sirawith - activist of Democratic Study Group was charged with Lese Majeste. The alledged offense were messages in Facebook Messenger where she had conversation with Burin, a man who had been convicted in another Lese Majeste case. The Military Prosecutor already filed charge against her before the military court on 1 August 2016. Patnaree was release on bail in the same day of her indictment.

Patnaree is a freelancer, working mostly as a housemaid. She provides the main financial support for the family because her husband passed away.

Patnaree had a conversation with Burin through Facebook Messenger. Burin said sentences that deemed to be Lese Majeste offense while Patnaree acknowlded the conversation.

6 May 2016

Post Today Online reported that the Military Court had issued an arrest warrant for Patnaree, under a charge of violation of Criminal Code Section 112. An inquiry officer explained that Patnaree had committed a crime with Burin, another accused under Section 112 case. Patnaree gave a short interview to reporters, saying “I’m appalled. This is unacceptable. I’m still working, waiting for my lawyer. And I’ll turn myself in”

After the Military Court had issued the arrest warrant in the morning, around 3.40 pm, Kom Chand Luek Online reported that Patnaree, accompanied by her lawyer, had gone to meet the inquiry officer at Technology Crime Suppression Division in order to turn herself in. She alleged that she did not know Burin personally. Patnaree’s legal team placed a bail of 500,000 Thai baht cash for her release during the investigation , but the bail was not allowed. Thus, Patnaree was taken into detention at Thung Song Hong Metropolitan Police Station.

8 May 2017

Prachatai reported that, in the morning, an inquiry officer took Patnaree from the Crime Suppression Division to the Military Court to request the Court order to detain her for 12 days during the investigation. Patnaree’s lawyer opposed the detention, stating that the accused did not have the tendency to escape or interfere with the evidence, and that she had the responsibility to support her family. However, the Court agreed to detain her, addressing that the condition he statedcondition stated by the lawyer was not fit for opposing detention, but was fit for requesting temporary release of the accused.

At around 12.30 am, Thai Lawyers for Human Rights reported that the Court released Patnaree on bail with a 500,000 Thai baht cash as guarantee, with the condition that she was prohibited from traveling overseas and must not exhibit any action that might cause any turmoil in the country. Patnaree was released from the prison at 4.10 p,m.

1 August 2016

Khaosod online reported that Patnaree went to meet with the military prosecutor. The military prosecutor filed charge against patnaree before the Military Court. The defense lawter deposit 500,000 Baht cash as bailbond. The Military Court granted Patnaree on bail with a condition not travelling out side the country and not participating in any politaical activities. Patbaree then was taken to be release at Wemen Correction Institution.
